MEDELMEDEL was informed that today thousands of judges and prosecutors in Turkey were arrested and dismissed.

While MEDEL has not sufficient elements to comment on the attempt of coup d'etat occurred in Turkey, it is hard to understand how and why judges and prosecutors performing daily their judicial duties can be involved in such facts and face detention for their freedom of judgment and opinion.

Vaclav Havel PrizeMEDEL – Magistrats Européens pour la démocratie et les libertés, has nominated two Turkish Judges (Metin Özçelik and Mustafa Başer) and four Turkish Prosecutors (Süleyman Bağrıyanık, Ahmet Karaca, Aziz Takçı and Özcan Şişman) to receive the Václav Havel Human Rights Prize 2016 of the Council of Europe.

MEDELMEDEL, gathered in Athens on May 23 to commemorate its 30th anniversary, was alarmed by the worsening of the situation of justice in Turkey.

MEDELOn the 30th anniversary of MEDEL – Magistrats Européens pour la Démocratie et les Libertés - Solidarity, Dignity, Justice

In June 1985, a group of European magistrates  - judges and prosecutors - founded MEDEL - Magistrats Européens pour la Démocratie et les Libertés, based on the strong belief that a united Europe could not be limited to free markets, but had to be based on fundamental rights and the Rule of Law in democratic societies.

Thirty years later, Europe has changed in ways that were then hardly imaginable – totalitarian regimes have fallen, democracy spread, borders opened and several new Member States joined the European Union.

Kathe Kollwitz The Lisbon Treaty has established a zone of justice, freedom and security between the European Union country members, which are required to honour the Charter of Fundamental Rights.

By publishing the Stockholm Programme for an area of freedom, security and justice at the service of its citizens in 2009, The European Union set before itself an ambitious task.

Justice has to be a force for democracy, effective both for the promotion of citizens’ rights and for the prevention of crime and corruption.

1. Medel's ambition is inspired by a civil society model: the principle goals of this association are to defend the independence of the judiciary power both with respect to any other power and to any particular interest, to ensure an unconditional respect for the values of democracy and the Rule of Law, to defend minority rights and divergent groups in perspective of social emancipation of the weakest.

Defend the independence of justice for the equality of citizens before the law.

2. The effectiveness of these rights depends on the people and institutions responsible for their application.

It is the role of the judiciary in particular to ensure fundamental rights and to prosecute criminal activity. In a crisis, the action of the administrative and financial courts is essential to ensure the legality and regularity of public resource allocation.
