INDEPENDANCE: Acteur clef de l’Etat de droit démocratique, elle est, selon des degrés divers, atteinte dans l’ensemble des pays; cela va de l’insuffisance des garanties statutaires à une totale ingérence du pouvoir exécutif voire à une détérioration. Les Conseils de justice -présents dans l’immense majorité des pays- doivent garantir l’indépendance de la justice et promouvoir un fonctionnement de celle-ci au service de tous ; leur composition doit garantir leur indépendance et respecter le pluralisme du système judiciaire.

EUThis 25th of March 2017 we celebrate the 60th anniversary of the signing of the Treaty of Rome, which marks the beginning of the process of European integration that led to the creation of the European Union.

What began as a project of peace building through economic integration quickly evolved to be the most ambitious process of peaceful social, political and juridical harmonisation of sovereign nations ever to be found in modern history.

MEDEL – MagistratsEuropéens pour la Démocratie et les Libertés, founded in 1985, has since the beginning inscribed within in its goals “the establishment of a common debate among magistrates from different Countries to support European community integration, in view of the creation of a European political union”.

Every day, as helpless onlookers, we see the terrible images of people dying at sea or on the frontiers of our countries. All of us have tales of emigration in our family trees, and all human beings are a result of the will, or the need, to change our location, our nation, or our continent. The history of mankind is nothing less than the history of migration.

MEDEL (Magistrats Européens pour la Démocratie et les Libertés) is an organization of European judges and prosecutors created with the main purpose to defend the independence of the judiciary, democracy and human rights. It currently comprises 22 national associations from 15 European countries, including Poland, and is an observer member of the Consultative Council of European Prosecutors of the Council of Europe (CCPE) and the Consultative Council of European Judges of the Council of Europe (CCJE).

MEDELThe Italian lawyer Barbara Spinelli was stopped on the frontier, in Istanbul airport, while she was travelling to Ankara to participate, as a speaker, to the International Conference “The judicial system under the state of emergency in Turkey”, organised by the European Association of Lawyers for Democracy and World Human Rights.

Your Excellency, MEDEL (Magistrats Européens pour la Démocratie et les Libertés), an organization of European judges and prosecutors created with the main purpose to defend the independence of the judiciary, democracy and human rights, currently comprises 22 national associations from 15 European countries, including Bulgaria, and is an observer member of the CCPE and the CCJE (within the Council of Europe).
It has come to our knowledge that the Bulgarian National Assembly is discussing amendments to the Judiciary System Act, and that included in those amendments is a proposal by the Parliamentary legislative committee that demands judges and prosecutors to declare before the Supreme Judicial Council their membership in professional organizations. According to the same proposals, the Supreme Judicial Council would maintain a registry containing these declarations.

Vaclav Havel PrizeMEDEL – Magistrats Européens pour la démocratie et les libertés, has nominated two Turkish Judges (Metin Özçelik and Mustafa Başer) and four Turkish Prosecutors (Süleyman Bağrıyanık, Ahmet Karaca, Aziz Takçı and Özcan Şişman) to receive the Václav Havel Human Rights Prize 2016 of the Council of Europe.

Greece - EULe parlement grec vient d’approuver dans la douleur « l’accord[i] » trouvé en urgence entre la Grèce et ses créanciers dans le cadre de son maintien dans la zone euro et de la perspective d’un troisième plan d’aide [ii]. Cet accord est intervenu dans un contexte de détresse accrue de la population grecque et lui impose de nouvelles « réformes sérieuses » dont des réformes juridiques comme celle du code de procédure civile [iii] et d’autres se traduisant par des nouvelles mesures d’austérité.

MEDELMEDEL, gathered in Athens on May 23 to commemorate its 30th anniversary, was alarmed by the worsening of the situation of justice in Turkey.

MEDEL therefore draws the attention of the international community to the situation of Turkish judiciary in which government orchestrating assault on judges and prosecutors reaches another low with every passing day.
