MEDEL expresses its deepest concern over the current attacks on the Italian judiciary launched through a media campaign and public statements by highest levels of government and institutions, accusing magistrates of pursuing politically biased investigations and prosecutions.
Another troubling threshold of interference and attacks on the judiciary has been crossed with the recent statements on the prosecutors engaged in a trial involving as defendant a Minister of the Republic for barring the Open Arms boat carrying 147 migrants rescued at sea from docking in Italy. Without any consideration of the legal arguments raised by the prosecutors and of the full compliance with the procedures provided by the legal system in the case of criminal proceedings against ministers, such statements have re-proposed to the public opinion the script of a judiciary playing an active opposition role to the government and its migration policies, and acting in defiance of the principle of separation of powers.
All this sounds even more alarming considering the reform plans to change the constitutional framework that has so far guaranteed the independence of prosecutors and the judiciary as a whole.
MEDEL reaffirms that:
-in a State where the Rule of Law applies, the judiciary, like any other institution that holds and exercises prerogatives in the interest of the community, should be accountable to the society it serves and be subject to the critical evaluation of its own actions;
– in a State where the Rule of Law applies, however, the boundary is clear between public criticism of the judiciary- which implies the mutual institutional respect proper to democratic dialectics- and its delegitimization, which represents instead a dangerous threat to its independence and a prejudice to the trust of the citizens in its impartiality and fairness;
– in a State where the Rule of Law applies, every individual and every action are subject to judicial scrutiny with regard to the respect of the rights protected by the applicable laws;
– in a State where the Rule of Law applies, judges and prosecutors act as guarantors of the equality of persons before the law, without distinction of their roles and functions, and protect those fundamental rights that our Constitutions and supranational norms grant, as universal rights, to all individuals.
Against the backdrop of the experience of erosion of the Rule of Law in Europe, showing that the judiciary is often the first target of regressive processes, MEDEL:
– calls for respect for the constitutional role of the judiciary;
-expresses its solidarity with all European magistrates committed to the defense of fundamental rights and Rule of Law.

Dichiarazione sugli attacchi e le interferenze contro la magistratura italiana
MEDEL esprime vivo allarme per gli attacchi portati alla magistratura italiana attraverso una campagna mediatica e pubbliche dichiarazioni, provenienti dai rappresentanti dei più alti livelli di governo e delle istituzioni, che accusano i magistrati di un uso politico strumentale delle indagini e dei processi.
Un’altra soglia preoccupante di interferenze e di attacchi è stata superata con le recenti dichiarazioni sui pubblici ministeri impegnati in un processo che vede imputato un Ministro della Repubblica per aver impedito alla nave Open Arms, che trasportava 147 migranti salvati in mare, di attraccare in Italia. Senza alcuna considerazione delle argomentazioni giuridiche portate dai procuratori e del pieno rispetto delle procedure previste dall’ordinamento giuridico nel caso di procedimenti contro ministri, tali dichiarazioni hanno riproposto all’opinione pubblica l’immagine di una magistratura che svolge un ruolo di opposizione attiva al Governo e alle sue politiche migratorie, e che agisce in spregio al principio della separazione dei poteri.
Tutto questo appare ancora più allarmante se si considerano i progetti di riforma in campo per modificare il quadro costituzionale che finora ha garantito l’indipendenza dei pubblici ministeri e della magistratura nel suo complesso.
MEDEL ribadisce che:
-in uno Stato di diritto, la magistratura, come qualsiasi altra istituzione che detiene ed esercita prerogative nell’interesse della comunità, risponde nei confronti della società che serve ed è soggetta alla valutazione critica delle proprie azioni;
– in uno Stato di diritto, tuttavia, è chiaro il confine tra la critica pubblica alla magistratura- che implica il rispetto istituzionale reciproco proprio della dialettica democratica – e la sua delegittimazione, che rappresenta invece una pericolosa minaccia all’ indipendenza del sistema giudiziario e un pregiudizio alla fiducia dei cittadini nella sua imparzialità ed equità;
– in uno Stato di diritto, ogni atto è soggetto al controllo di conformità per quanto riguarda il rispetto dei diritti fondamentali tutelati dalle leggi applicabili;
– in uno Stato di diritto, i giudici e i pubblici ministeri agiscono come garanti dell’uguaglianza delle persone davanti alla legge, senza distinzione di ruoli e funzioni, e proteggono quei diritti fondamentali che le nostre Costituzioni e le norme sovranazionali garantiscono, come diritti universali, a tutti gli individui.
Sullo sfondo dell’esperienza di regressione dello Stato di diritto in Europa, che dimostra come i sistemi giudiziari siano spesso il primo bersaglio dei processi di arretramento democratico, MEDEL:
– chiede che sia rispettato il ruolo costituzionale della magistratura;
-esprime la sua solidarietà a tutti i magistrati europei impegnati nella difesa dei diritti fondamentali e dello Stato di diritto.
