MEDEL pronounced the 23rd of May as the alert day for the independence of justice in Europe, remembering the anniversary of the assassination of the Italian Judge Giovanni Falcone by the Mafia in 1992.
On this date, we are invited to reflect on the need for an independent and effective justice all over Europe and its importance for the safeguard of European citizens’ fundamental rights and freedoms. All European citizens must be remembered of the essentiality of an independent judiciary, able to protect the basic freedoms and rights all over Europe.
The growing nationalist and populist movements that have been spreading all over the continent, the unprecedented attacks against the independence of the Judiciary that we have been witnessing in countries like Hungary or Poland and the disrespect for basic principles of the Rule of Law in countries like Turkey (a member of the Council of Europe), remind us that the existence of an independent Judiciary must never be taken for granted and that it is a constant and fundamental struggle for every citizen in any country.
Next Saturday, May 26th, MEDEL will mark this occasion in Brussels with a seminar co- organised with AED – Avocats Européens Démocrates, where the contribution of lawyers and magistrates to the building of an independent justice system will be discussed.
On this day, MEDEL especially wants to pay tribute and once again express its full solidarity to all those that are paying a high price for the courage of fighting for democracy, the Rule of Law and the independence of the Judiciary, symbolized by Murat Arslan (President of YARSAV, the Turkish Judges Association), arrested for more than two years in Turkey and to whom the Parliamentary Assembly of the Council of Europe has awarded the Vaclav Havel Human Rights Prize in 2017.
European citizens can be sure that MEDEL will always be in the first line of the combat for an independent Judiciary: we owe it to the memory of Giovanni Falcone; we owe it to the future of Europe.

Pour une justice independante en Europe
MEDEL a prononcé le 23 mai comme le jour d’alerte pour l’indépendance de la justice en Europe, en se souvenant de l’anniversaire de l’assassinat du juge italien Giovanni Falcone par la mafia en 1992.
À cette date, nous sommes invités à réfléchir sur la nécessité d’une justice indépendante et efficace dans toute l’Europe et son importance pour la sauvegarde des droits et libertés fondamentaux des citoyens européens. Il faut rappeler à tous les citoyens européens l’essentialité d’un pouvoir judiciaire indépendant, capable de protéger les libertés et les droits fondamentaux dans toute l’Europe.
Les mouvements nationalistes et populistes qui se répandent partout sur le continent, les attaques sans précédent contre l’indépendance du Pouvoir Judiciaire que nous avons témoigné dans des pays comme la Hongrie ou la Pologne et le manque de respect pour les principes fondamentaux de l’État de Droit dans des pays comme la Turquie (membre du Conseil de l’Europe) nous rappellent que l’existence d’un Pouvoir Judiciaire indépendant ne doit jamais être considérée comme acquise et qu’il s’agit d’une lutte constante et fondamentale pour tous les citoyens de tous les pays.
Samedi prochain, le 26 mai, MEDEL marquera cette occasion à Bruxelles avec un séminaire co-organisé avec AED – Avocats Européens Démocrates, où la contribution des avocats et des magistrats pour la construction d’un système de justice indépendant sera discutée.
En ce jour, MEDEL veut surtout rendre hommage et exprimer une fois de plus sa pleine solidarité à tous ceux qui paient un prix élevé pour le courage de lutter pour la Démocratie, l’État de Droit et l’indépendance du Pouvoir Judiciaire, symbolisées par Murat Arslan (Président de YARSAV, l’association des juges turcs), emprisonné il y a plus de deux ans en Turquie et à qui l’Assemblée Parlementaire du Conseil de l’Europe a décerné le prix Vaclav Havel des Droits de l’Homme en 2017.
Les citoyens européens peuvent être sûrs que MEDEL sera toujours dans la première ligne du combat pour un Pouvoir Judiciaire indépendant: nous le devons à la mémoire de Giovanni Falcone; nous le devons au futur de l’Europe.
