The governing body of Spanish judges, the General Council of the Judiciary, has not been renewed for more than five years, which represents an unacceptable non-compliance over time with the constitutional postulates that require its renewal every five years.
MEDEL urges the competent Spanish authorities to put an end to this democratic anomaly, which is causing important dysfunctions in the public service provided by the Judiciary.
MEDEL follows as well with concern the recent developments in connection with a press release of the Office of the Prosecutor General.
MEDEL respects the ongoing judicial procedure to verify, in an independent and impartial manner, whether illegal acts of any kind have been committed.
Nonetheless MEDEL reiterates that the conditions must be guaranteed that allow the Office of the Prosecutor General, a body of constitutional relevance integrated into the Judiciary, to implement its functions in an autonomous and independent way. A correct information represents a duty towards citizens and a guarantee of transparency, that is in its turn a crucial component of the rule of law and a precondition to ensure the public trust in the correct functioning of the judicial system.
Respect for the Judiciary as a whole and for the institutions that comprise it is essential for the normal functioning of the rule of law.

MEDEL expresa su preocupación por la situación de la justicia en España.
El órgano de gobierno de los jueces españoles, el Consejo General del Poder Judicial, lleva más de cinco años sin ser renovado, lo que supone un inaceptable incumplimiento mantenido en el tiempo de los postulados constitucionales que exigen su renovación cada cinco años.
MEDEL insta a las autoridades españolas competentes a poner fin a esta anomalía democrática, que está provocando importantes disfunciones en el servicio público que presta el Poder Judicial.
MEDEL sigue también con preocupación los recientes acontecimientos relacionados con un comunicado de prensa de la Fiscalía General del Estado.
MEDEL respeta el procedimiento judicial en curso para verificar, de forma independiente e imparcial, si se han cometido actos ilegales de cualquier tipo.
No obstante, MEDEL reitera que deben garantizarse las condiciones que permitan a la Fiscalía General del Estado, órgano de relevancia constitucional integrado en el Poder Judicial, ejercer sus funciones de forma autónoma e independiente. Una correcta información representa un deber para con los ciudadanos y una garantía de transparencia, que es a su vez un componente crucial del Estado de Derecho y una precondición para asegurar la confianza pública en el correcto funcionamiento del sistema judicial.
El respeto al Poder Judicial en su conjunto y a las instituciones que lo componen es esencial para el normal funcionamiento del Estado de Derecho.
