While the representatives of the member States of the European Union are discussing the budget of the Union for the forthcoming years, they consider introducing a new rule, which would allow the European Commission to cut the access to European funds to a member State who violates the fundamental principles of the Rule of Law.
MEDEL has to underline that respect for the Rule of Law is not a budgetary matter or something that one may use as a political weapon, but one of the very foundations of the European Union, if not the most critical one. Whether or not a Member State receives regional funds, it cannot opt out.
Nevertheless, whereas we witnessed several violations of fundamental rights of European citizens and foreigners in some member States in the past years (threats on the independence of the judiciary in Poland, Bulgaria and Romania, violation of fundamental rights of migrants in Hungary and Italy, violation of freedom of assembly in France, amongst others), MEDEL holds this new regulation to be necessary and an essential instrument to protect the Rule of Law in the EU.
MEDEL, as many European citizens and NGO’s involved in various initiatives to strengthen the effectiveness of fundamental rights throughout the continent, holds this truth to be self-evident: that every Member State has the duty to respect, but also to promote the rule of law.

COMMUNIQUE DE MEDEL SUR LA CLAUSE DE CONDITIONNALITE LIEE A L’ETAT DE DROIT
Alors que les représentants des Etats membres de l’Union européenne sont actuellement en train de débattre du budget de l’Union pour les années à venir, il est question d’introduire une nouvelle règle qui permettrait à la commission européenne de suspendre le versement des aides régionales aux Etats qui ne respecteraient pas les principes fondamentaux de l’Etat de droit.
MEDEL doit souligner que le respect de l’Etat de droit ne saurait être réduit à une question budgétaire ou une mesure de rétorsion mais constitue l’un des fondements de l’Union Européenne, si ce n’est le plus important. Qu’un Etat membre bénéficie ou non de fonds régionaux, il ne peut s’y soustraire.
Néanmoins, alors que nous avons assisté à plusieurs atteintes aux droits fondamentaux de citoyens de l’Union européenne ou d’ailleurs au cours des dernières années (menaces sur l’indépendance de la justice en Pologne, Bulgarie et Roumanie, atteinte aux droits fondamentaux des migrants en Hongrie et en Italie, atteinte à la liberté de manifester en France, entre autres), MEDEL considère l’introduction d’une telle règle nécessaire et un instrument essentiel à la protection de l’État de droit dans l’UE.
MEDEL, à l’image de nombreux citoyens et ONG européens engagés dans des initiatives visant à renforcer l’effectivité des droits fondamentaux sur le continent, tient pour évident que chaque Etat membre a le devoir non seulement de respecter l’Etat de droit, mais encore de le promouvoir.
