Tirza Del Carmen Flores Lanza and Guillermo López Lone, appeal court judge and judge in the district court of San Pedro Sula, Honduras, together with two colleagues, took part in a demonstration against the coup d’État that in 2009 deposed president Zelaya. Both have been members and co- founders of the Asociación de Jueces por la Democracia, in Honduras.
During this time, the judges took actions in defense of the rule of law and carried out their duties to defend it. They were dismissed from their positions for actions such as participating in demonstrations against the coup, publishing newspaper articles opposing the new government and making comments against the coup to judicial colleagues.
After having opposed the bloody coup d’État that toppled then-President Manuel “Mel” Zelaya on June 28, 2009, the four dismissed Honduran judges obtained full reparation from the Inter-American Court of Human Rights in 2015. On November 10, 2015, the Inter-American Court of Human Rights (Court) ruled (in Lopez Lone and others v. Honduras) that the State had violated the American Convention on Human Rights (Convention) by disciplining and dismissing judges who spoke out against the coup d’État in 2009. The Court stressed that representative democracy is one of the pillars of both the Convention and the Organization of American States and noted that the coup d’État violated international law. Despite that fact, and that the Honduran government paid the compensation in 2017, they were not reinstated in their positions.
Now, the decision of the Inter-American Court of Justice, issued in 2015, is finally being fully implemented. After international pressure, the Supreme Court of Honduras announced on September 24th, 2018, that Tirza Flores Lanza and Guillermo López Lone have to be reinstated in their positions and under the previous conditions.
Magistrats européens pour la démocratie et les libertés (MEDEL) and its member associations have supported the lawsuits from the very beginning and welcome the fact that the ruling of the Inter- American Court has finally been fully implemented. This outcome shows that Tirza’s and Guillermo’s long and arduous struggle for justice has been worth it. It is a great moral victory and success not only for the directly affected judges, but for all Honduran judges who are prepared to defend the rule of law and democracy. MEDEL wishes to congratulate and express its full solidarity with all the judges that courageously defend those basic values.

Honduras: Apres le coup d’état contre le President Manuel Zelaya (2009), les Juges licencies sont finalement reintegres
Tirza del Carmen Flores Lanza et Guillermo López Lone, juge de la Cour d’Appel et juge de première instance à San Pedro Sula, Honduras, ont participé, avec deux collègues, à une manifestation contre le coup d’État qui, en 2009, a déposé le président Zelaya. Tous deux ont été membres et co-fondateurs de l’Asociación de Jueces por la Democracia, au Honduras.
Pendant ce temps, les juges ont pris des mesures pour défendre l’état de droit et ont exercé leurs fonctions pour la protéger. Ils ont été licenciés de leurs positions pour des actions telles que participer à des manifestations contre le coup d’État, publier des articles en s’opposant au nouveau gouvernement et faire des commentaires contre le coup d’État à des collègues.
Après son opposition au coup d’État sanglant qui a renversé le président Manuel “Mel” Zelaya le 28 juin 2009, les quatre juges du Honduras licenciés ont obtenu une réparation complète de la part de la Cour Interaméricaine des Droits de l’Homme en 2015. Le 10 novembre 2015, la Cour Interaméricaine des Droits de l’Homme a décidé (dans Lopez Lone et autres c. Honduras) que l’État avait violé la Convention Américaine des Droits de l’Homme en punissant et en licenciant les juges qui se sont prononcés contre le coup d’Etat en 2009. La Cour a souligné que la démocratie représentative est l’un des piliers de la Convention et de l’Organisation des États Américains et a noté que le coup d’État violait le droit international. Malgré ce fait, et que le gouvernement hondurien avait déjà payé l’indemnité en 2017, ils n’ont pas été réintégrés dans leurs positions.
Cette décision de la Cour Interaméricaine, prononcée en 2015, est enfin pleinement exécutée. Après la pression internationale, la Cour Suprême du Honduras a annoncé le 24 septembre 2018 que Tirza Flores Lanza et Guillermo López Lone seront réintégrés dans leurs positions et dans les conditions précédentes.
Magistrats Européens pour la Démocratie et les Libertés (MEDEL) et ses associations membres ont soutenu les procédures des juges licenciés dès le début et se félicitent du fait que la décision de la Cour Interaméricaine a finalement été pleinement exécutée. Ce résultat démontre que la lutte longue et ardue de Tirza et Guillermo pour la justice en a valu la peine. C’est une grande victoire morale et un succès non seulement pour les juges directement touchés, mais pour tous les juges du Honduras qui sont prêts à défendre l’état de droit et la démocratie.
MEDEL souhaite féliciter et exprimer sa pleine solidarité avec tous les juges qui défendent courageusement ces valeurs fondamentales.
