The serious events that occurred in Ceuta, with the tragic result of at least 72 deceased individuals, as well as a high number of injured and missing persons still to be determined, demand an institutional response founded on respect for the Rule of Law and human and fundamental rights. Before any other consideration, we wish to express our sorrow for the loss of human lives.
Border control constitutes a legitimate competence of the State and responds to the obligation to guarantee security and compliance with legality. However, this power must always be exercised within the constitutional framework and the international commitments assumed by Spain regarding human rights, and no purpose, however legitimate, can be prioritized over respect for the life and dignity of individuals.
Situations of special migratory pressure do not alter the validity of fundamental rights nor do they lower the requirements proper to the Rule of Law. It is precisely in contexts of maximum difficulty when democratic institutions must reaffirm their commitment to legality and proportionality, regardless of the origin or administrative status of the affected persons. Therefore, these events cannot become a pretext to fuel hate speech, xenophobia, or calls for the persecution of migrants.
These events demonstrate, once again, the need to move towards a comprehensive and coordinated migration policy within the European Union, combining effective border management with the protection of fundamental rights and the safeguarding of the lives of migrants. Firmness in border control and respect for fundamental rights are not incompatible: both are part of the obligations of a social and democratic State governed by the Rule of Law. Only from this balance will it be possible to offer a response in line with our constitutional and European values, and to prevent a human tragedy from turning into a cause of social fracture.
We call for the public debate on these events to be carried out with rigor and institutional respect, avoiding simplistic answers or speeches that erode coexistence. Comunicado conjunto MEDEL, JJpD, UPF y APDHE reclamando respeto a los Derechos Humanos en la crisis humanitaria de Ceuta
Los graves acontecimientos ocurridos en Ceuta, con el trágico resultado de al menos 72 personas fallecidas, así como un elevado número de personas heridas y desaparecidas aún por determinar, exigen una respuesta institucional fundada en el respeto al Estado de Derecho y a los derechos humanos y fundamentales. Antes que cualquier otra consideración, queremos expresar nuestro dolor por la pérdida de vidas humanas.
El control de las fronteras constituye una competencia legítima del Estado y responde a la obligación de garantizar la seguridad y el cumplimiento de la legalidad. Ahora bien, esa potestad debe ejercerse siempre dentro del marco constitucional y de los compromisos internacionales asumidos por España en materia de derechos humanos, sin que ninguna finalidad, por legítima que sea, pueda anteponerse al respeto a la vida y a la dignidad de las personas.
Las situaciones de especial presión migratoria no alteran la vigencia de los derechos fundamentales ni rebajan las exigencias propias del Estado de Derecho. Precisamente en los contextos de máxima dificultad es cuando las instituciones democráticas deben reafirmar su compromiso con la legalidad y la proporcionalidad, cualquiera que sea el origen o la situación administrativa de las personas afectadas. Por ello, estos acontecimientos no pueden convertirse en pretexto para alimentar el discurso de odio, la xenofobia o el llamamiento a la persecución de las personas migrantes.
Estos hechos ponen de manifiesto, una vez más, la necesidad de avanzar hacia una política migratoria integral y coordinada en el ámbito de la Unión Europea, que combine una gestión eficaz de las fronteras con la protección de los derechos fundamentales y la salvaguarda de la vida de las personas migrantes. La firmeza en el control fronterizo y el respeto a los derechos fundamentales no son incompatibles: ambos integran las obligaciones de un Estado social y democrático de Derecho. Solo desde ese equilibrio será posible ofrecer una respuesta acorde con nuestros valores constitucionales y europeos, y evitar que una tragedia humana se transforme en un motivo de fractura social.
Hacemos un llamamiento para que el debate público sobre estos hechos se desarrolle desde el rigor y el respeto institucional, evitando respuestas simplistas o discursos que erosionen la convivencia. Detrás de cada frontera hay seres humanos, y ninguna respuesta política puede olvidar que la protección de su vida y su dignidad constituye un deber ineludible.
