Following what was mentioned in its statement on March 20th, 2022, MEDEL keeps following closely the developments in Tunisia, and especially the changes to the Tunisian Judiciary.
As in that statement MEDEL expressed, the violation of the Constitution by the dissolution of the CSM and the subsequent takeover of a “provisional” CSM by the executive branch seriously undermined the rule of law, the principle of the separation of powers and the independence of the judiciary as enshrined in international law.
This unacceptable situation of violation of the basic principle of separation of powers further deepened with the adoption on June 1st, 2022, of a decree giving to the President of Tunisia the absolute power to summarily dismiss magistrates, which immediately led to the dismissal of 57 judges, without any due process or guarantees of defense.
MEDEL once again cannot remain silent and reaffirms its commitment to continue to mobilize alongside the Tunisian judges and all democrats in this country who aspire to a serene future in the fullness of a democracy.
In view of this new direct attack to the independence of the Judiciary in Tunisia, MEDEL fully subscribes and joins the appeal of June 10th, 2022, of the International Federation for Human Rights, and asks for the immediate revocation of the decree and the reinstatement of all dismissed judges.

DÉCLARATION SUR LES DÉVELOPPEMENTS CONCERNANT LE SYSTÈME JUDICIAIRE TUNISIEN
Suite à ce qui a été mentionné dans sa déclaration du 20 mars 2022, MEDEL continue de suivre de près les développements en Tunisie, et en particulier les changements dans le système judiciaire tunisien.
Comme MEDEL l’a exprimé dans cette déclaration, la violation de la Constitution par la dissolution du CSM et la prise de contrôle subséquente d’un CSM “provisoire” par le pouvoir exécutif a gravement porté atteinte à l’Etat de Droit, au principe de la séparation des pouvoirs et à l’indépendance du pouvoir judiciaire tels que consacrés par le droit international.
Cette situation inacceptable de violation du principe fondamental de séparation des pouvoirs s’est encore aggravée avec l’adoption, le 1er juin 2022, d’un décret donnant au Président tunisien le pouvoir absolu de révoquer sommairement les magistrats, ce qui a immédiatement conduit à la révocation de 57 juges, sans aucune procédure régulière ni garantie de défense.
Une fois de plus, MEDEL ne peut rester silencieux et réaffirme son engagement à continuer à se mobiliser aux côtés des juges tunisiens et de tous les démocrates de ce pays qui aspirent à un avenir serein dans la plénitude d’une démocratie.
Face à cette nouvelle attaque directe contre l’indépendance de la Justice en Tunisie, MEDEL souscrit pleinement et se joint à l’appel du 10 juin 2022 de la Fédération Internationale pour les Droits Humains, et demande la révocation immédiate du décret et la réintégration de tous les juges révoqués.
