Statement of MEDEL of solidarity with its brazilian Public Prosecution partner organisations, regarding the proposed changes intended to reduce the role of Public Prosecution in criminal investigations (in English and Portuguese):
MEDEL – Magistrats Européens pour la Démocratie et les Libertés has been given notice by its partner organisations of Brazilian Public Prosecutors, of the ongoing debate in the Brazilian Parliament about changes to the Criminal Procedure Code, namely the opinion presented on April 14th, 2021, suggesting that the competence in criminal investigation should be given to the police, leaving to the Public Prosecution a mere accessory role.
MEDEL sees with much surprise this new proposal, as the understanding that the Public Prosecutor’s Office has full power of criminal investigation had been consolidated since the previous debate of similar proposals, in 2013, with a negative vote by a large majority in the Parliament and the subsequent decision of the Supreme Federal Court.
MEDEL recalls its “Naples Declaration of Principles Concerning the Public Prosecutor”, adopted on 2 March 1996, reaffirmed in the “Declaration of Firenze”, adopted in 20 September 2020, where it clearly stated that “the magistrates of the public prosecutor ensure the equality of citizens in front of the law”, and it is “the function of the Public Prosecutor to promote the application of the law while ensuring the respect of legality, of the fundamental rights and of equality in front of the law”. Seen these principles, MEDEL sees with utmost concern the proposal of giving to the Public Prosecution a mere accessory and complementary role in criminal investigation, as it will deprive citizens of the right to have investigations conducted by an independent magistracy, that is in position to promote equality of all in front of the law and the respect for fundamental rights, as well as being a crucial element in the fight against corruption.
MEDEL also fears that giving a mere accessory and complementary role to the Public Prosecution in criminal investigation will put at risk the negotiations of judicial cooperation between Brazil and Eurojust, recently announced by the European Commission, as that change does not meet the international standards on the independence of the Public Prosecution.
MEDEL hereby expresses its full solidarity with its Brazilian partner organisations of Public Prosecutors and calls on the Brazilian Parliament to reconsider the above mentioned proposal.

DECLARAÇÃO DE SOLIDARIEDADE DA MEDEL COM O MINISTÉRIO PÚBLICO BRASILEIRO
A MEDEL – Magistrats Européens pour la Démocratie et les Libertés foi informada pelas suas organizações parceiras do Ministério Público brasileiro, sobre o debate em curso no Parlamento Brasileiro quanto a alterações ao Código de Processo Penal, nomeadamente o parecer apresentado em 14 de abril de 2021, sugerindo que a competência em matéria de investigação criminal deveria ser atribuída à polícia, deixando ao Ministério Público um papel meramente acessório.
A MEDEL vê com muita surpresa esta nova proposta, pois o entendimento de que o Ministério Público tem plenos poderes de investigação criminal estava consolidado desde o debate anterior de propostas semelhantes, em 2013, com um voto negativo por larga maioria no Parlamento e a subsequente decisão do Supremo Tribunal Federal.
A MEDEL recorda a sua “Declaração de Nápoles sobre os Princípios do Ministério Público”, adotada em 2 de março de 1996, reafirmada na “Declaração de Firenze”, adotada em 20 de setembro de 2020, onde afirmou claramente que “os magistrados do Ministério Público asseguram a igualdade dos cidadãos perante a lei”, sendo “função do Ministério Público promover a aplicação da lei, assegurando simultaneamente o respeito da legalidade, dos direitos fundamentais e da igualdade perante a lei”. Atendendo a estes princípios, MEDEL vê com extrema preocupação a proposta de dar ao Ministério Público um papel meramente acessório e complementar na investigação criminal, uma vez que privará os cidadãos do direito a que as investigações sejam conduzidas por uma magistratura independente, que esteja em posição de promover a igualdade de todos perante a lei e o respeito pelos direitos fundamentais, além de ser um elemento crucial na luta contra a corrupção.
A MEDEL receia também que a atribuição de um papel meramente acessório e complementar ao Ministério Público na investigação criminal ponha em risco as negociações de cooperação judicial entre o Brasil e a Eurojust, recentemente anunciadas pela Comissão Europeia, uma vez que essa alteração não vai de encontro aos standards internacionais sobre a independência do Ministério Público. A MEDEL manifesta total solidariedade com as suas organizações parceiras do Ministério
Público do Brasil e apela ao Parlamento Brasileiro para que reconsidere a proposta acima referida.
